The manner in which accommodations are provided generates numerous heated conflicts for postsecondary institutions. The struggle to balance the interests and concerns of all impacted individuals (e.g., students with disabilities, instructors, other students, parents, etc.) is becoming increasing difficult. How would you resolve the situations described below?
A faculty member complains that his class is being disrupted by a student with a service animal frequently placing the animal in a down position because the animal jumps up whenever students enter or leave the class.
A student with a spectrum disorder requests that her personal care attendant be permitted to accompany her to class to ensure she properly participates in class.
A student participating in a clinical program is ordered to leave the program because a proctor believes he poses a health and safety risk to patients.
A faculty member refuses to provide accommodations approved for a student expressing the belief that if he could provide a justification as to why the accommodations were not needed he did not have to provide them.
College administrators request that a student with a seizure disorder enroll in the online program in response to the fact that the student has had seizures while attending classes.
A student who took a medical leave for a psychiatric condition is required to submit medical documentation that s/he is capable of resuming academic work.
A student objects to the University's policy that requires that the names of students registered with the disability services office be provided to the Behavior Intervention Team.
In this webinar, we will discuss the key considerations that must be addressed when balancing the rights or interests of parties that are equally important and in conflict. Proper resolution of such cases require institutions to ensure that the deliberative process is conducted in good faith. Additionally, policies and procedures adopted to manage such situations must not inappropriately treat students with disabilities differently, deny them due process and/or fail to safeguard their academic wellbeing. |
